Description
This research will be conducted under a proposed cluster that straddles
the interface of business and law and considers the implications of
regulatory desires and requirements (driven by societal demands) in a
very practical and highly relevant way – in particular the implications for
the commercial sector.
In respect of this research proposal: Paternalistic laws may be considered
as those that restrict an individual’s freedom of choice but which are
adopted from the greater good argument perspective. In this particular
instance legal research will be applied through a business case lens to
consider the practical implications for business and the impact of
regulation (for example in areas of social concern such as restrictions on
the sale of alcohol and display of tobacco products) upon the convenience
retail sector in the mid-west region. This will allow for meaningful insights
in the boundaries of law and the impact of legal rules upon both the
business sector and business development.
